I have represented and counseled many franchisors and franchisees in court and arbitration. Franchise is a complex and intricate area of the law. I have extensive knowledge and experience in litigating every aspect of franchise, including Florida Statutes, contracts, operations and finance, termination, trade secrets, non-compete/solicitation agreements, to name but a few.

Franchise can be an attractive, successful, hands-on investment and lifestyle for many individuals and couples, but it has its risks. It creates a long-term, parent/child business relationship, in which the franchisor promises to fully and competently nurture the franchisee to success. In turn, the franchisee pays a royalty percentage of revenue, pledges loyalty and confidentiality, agrees to undergo training, and promises to follow and apply the franchise system’s exact method and manner of doing business. Of course, those promises can be broken, and that is where the trouble comes in, whether it involves royalties, employees, insurance, location, or the failure to perform obligations under the franchise agreement and associated documents.
